Drivers could be hit with a financial blow and points on their driving licence by breaking a little-known rule this summer. Motorists across the UK could be slapped with a £200 fine and penalty points on their driving licence for making a simple mistake behind the wheel as hot weather hits this week.

Ash Young, an expert from motoring specialists at 1Dot, stressed that eating ice cream while behind the wheel could backfire, with hefty penalties a possibility. While they accept there is no specific law against eating while in control of a vehicle, becoming distracted could be a serious issue. Ice creams are a summer staple and are likely the first snack many will reach for on a hot day.

The UK is set to bask in another heatwave this week, with Friday expected to be the warmest day of the week.

The Met Office has tipped temperatures to soar as high as 27 Celsius on Friday with the warm weather continuing into the weekend,

Ash said: “Most drivers don’t realise that something as innocent as eating an ice cream cone can be classed as ‘driving without due care and attention’ if it affects your ability to control the vehicle.

“If police judge that you’re distracted or not fully in control, you could be hit with an on-the-spot fine of £200 and up to six points on your licence.”

According to 1Dot, simple actions such as reaching for snacks can fall under Section 3 of the Road Traffic Act 1988.

This covers careless driving, which could be a serious blow for road users heading out to enjoy the start of summer.

Ash added: “Ultimately, it’s not about banning food – it’s about safety. If you’re eating with one hand and lose focus for a second, it could have serious consequences for you and other road users.”

Instructors at Just-Drive have warned that even a short lapse of concentration could be enough to land road users in serious trouble.

The specialists warn that even taking eyes off the road for a second while a car is standstill could also be a serious risk.

They explained: “The process of eating causes visual, manual and cognitive distraction. Hazards can present themselves at any time, whether the car is moving or still, and you need to be prepared to respond in an appropriate (and timely!) manner.”
